An internet resource on mental health law in England & Wales, primarily for mental health practitioners, to which anyone can contribute.

There are currently three sections to this website which are developing into the following:

Regularly updated commentaries on the cases, with links to the full text judgments on Bailii. (Currently 508 categorised cases plus 54 other Bailii links.)   The full text of, and a simple and up-to-date commentary on, the Mental Health Act 1983, the Mental Capacity Act 2005, and related legislation.   General articles to explain the concepts and terminology used in the caselaw and legislation sections; and practical guidance for lawyers

Recent updates
  • 21/06/09: New judgment handed down on 17/6/09.. Gray v Thames Trains Ltd (2009) UKHL 33 — The principle of ex turpi causa prevented the claimant from recovering for damage which was the consequence of his committing the offence of manslaughter.
  • 17/06/09: Please get in touch if you have been involved in any Tribunal reviews/appeals. Brief details of the legal principles involved could be put on the website.. See Help page for contact details.
  • 15/06/09: New case added.. Roach v Home Office (2009) EWHC 312 (QB) — The costs of attending an inquest can in principle be recovered by way of costs in subsequent civil proceedings; the fact that the inquest work was covered by a public funding certificate had no bearing on the recoverability of the costs.
